Terms of Use

1. The agreement

These Terms are a contract between you and redd.email (“we”, “us”) covering the redd.email website, mobile apps, and mail servers (the “Service”). By creating an account, claiming a mailbox, or using the Service in any way, you accept them. If you do not accept them, do not use the Service. Our Privacy Policy is part of this agreement.

2. Who may use it

You must be at least 13 years old, and old enough to enter a binding contract where you live, or have a parent or guardian agree on your behalf. If you are using redd.email for an organization, you are confirming that you are authorized to bind it, and “you” means that organization.

3. Your account

• Your phone number is your key. Sign-in works by texting a one-time code to your number. Anyone who controls that number can get into your account, and losing the number can cost you access to your mail. Keep it current, and tell us before you give it up.
• App passwords. Passwords generated for Apple Mail and other IMAP clients grant full access to your mailbox. Treat them as secrets, and revoke ones you no longer use.
• Responsibility. You are responsible for everything done through your account. Tell us promptly at support@redd.email if you believe it has been compromised.
• Accuracy. Give us accurate information and keep it up to date.

4. Domains and mailboxes

• When you ask us to register a domain, we register it through our registrar on your behalf. Domain registrations are also governed by ICANN policy and our registrar’s terms, which can require things we do not control — accurate registrant data, verification, and renewal deadlines among them.
• When you connect a domain you already own, you confirm that you have the right to use it and to point its mail records at us.
• If you administer a domain, you may create mailboxes for other people. You are responsible for what those users do, and for having their permission before you enter their phone number to invite them.
• A domain administrator can see the existence of mailboxes on their domain and can remove them, which can cut off the person using one.
• You may not register or use a domain to impersonate someone else or to infringe a trademark.

5. Acceptable use

Do not use redd.email to:

• send unsolicited bulk mail, spam, or commercial messages to people who did not ask for them, or operate a mailing list without verified consent;
• send phishing messages, malware, or anything designed to deceive or damage a recipient;
• forge headers, spoof a sender, or otherwise disguise the origin of a message — including using a disposable mailbox to evade a block or ban;
• harass, threaten, defame, or stalk anyone, or transmit content that is illegal where you or the recipient are;
• distribute child sexual abuse material, or content that infringes someone’s copyright or other rights;
• probe, scan, overload, or attempt to break the Service, our providers, or any other system; or circumvent rate limits, quotas, or access controls;
• resell the Service, or use it as backing infrastructure for another product, without our written permission;
• use automated means to consume resources far beyond what a normal mailbox uses.

Mail is a shared reputation system: abuse from one account can get every redd.email user’s mail blocked elsewhere. We enforce this section aggressively for that reason.

6. Your content

Your mail is yours. You keep all rights to it. You grant us only the narrow license we need to run the Service — to store, transmit, index, back up, scan for spam and malware, and display your content back to you and to the people you send it to. That license ends when you delete the content or your account, apart from copies sitting in backups until they age out.

We do not monitor mail routinely. We may review specific content when we are investigating a report of abuse, responding to a legal request, or fixing a problem you have asked us to fix.

7. Fees and billing

• Paid plans are billed in advance through Stripe on a recurring basis until you cancel. By subscribing you authorize those recurring charges.
• Cancel any time; your plan stays active through the end of the period you already paid for. Fees already paid are not refundable except where the law requires it.
• Domain registration and renewal fees are separate, are set by the registry, and are generally non-refundable once a domain is registered.
• We may change prices with at least 30 days’ notice before the change hits your next renewal.
• If a payment fails, we may suspend the account. Mail continues to arrive for a grace period, after which we may stop accepting it and eventually delete the account.

8. Messages from us

We will text you one-time sign-in codes when you request them, and a mailbox invitation if someone creates an address for you. We do not send marketing texts. Message and data rates may apply. Reply STOP to opt out of texts from us; doing so will prevent you from receiving sign-in codes, which means you will not be able to sign in. Reply HELP or write to support@redd.email for help. We may also email you service notices about security, billing, or changes to these Terms; you cannot opt out of those while you have an account.

9. Availability and changes to the Service

We work to keep redd.email running, but we do not promise a specific level of uptime. The Service depends on providers we do not control, and mail delivery in particular depends on other providers’ decisions about whether to accept our mail. We may add, change, or remove features. If we discontinue a feature you rely on, or the Service as a whole, we will give you reasonable notice and a way to export your mail.

10. Suspension and termination

You can stop using the Service at any time and ask us to delete your account. We may suspend or terminate your account if you break these Terms, if your use puts the Service or other users at risk, if payment fails, or if we are required to by law. Where the circumstances allow, we will warn you first and give you a chance to export your mail. For serious abuse — spam campaigns, phishing, illegal content — we may act immediately and without notice.

11. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, that every message will be delivered or received, or that mail will never be lost. Keep your own copies of anything you cannot afford to lose.

12. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost business, or lost or corrupted data, even if we were told such damages were possible. Our total liability for any claim relating to the Service is capped at the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.

Some jurisdictions do not allow these limits, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.

13. Indemnification

You will defend and indemnify us against claims, damages, and costs (including reasonable legal fees) arising from your use of the Service, your content, your domains, or your breach of these Terms.

14. Governing law and disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules. You and we agree to bring any dispute exclusively in the state or federal courts located there, and each of us consents to their jurisdiction. If any provision of these Terms is held unenforceable, the rest stays in force.

15. Changes to these Terms

We may revise these Terms. For material changes we will give notice by email or in the app at least 30 days before they take effect, and update the effective date above. Continuing to use the Service after that means you accept the new version; if you do not, cancel and export your mail before it takes effect.

16. Everything else

These Terms and the Privacy Policy are the whole agreement between us about the Service. Our not enforcing a provision is not a waiver of it. You may not transfer this agreement without our consent; we may transfer it as part of a sale or reorganization of the Service.
